https://safirsoft.com California State Department Appeals Judge Refused to Intervene in EEOC Activision Blizzard Settlement

As 2022 begins, Activision Blizzard is trying to get past a year of scandal and come to an agreement with the Equal Employment Opportunity Commission (EEOC). However, the California Department of Housing and Fair Employment (DFEH) is doing everything it can to prevent settlement.

Last September, Blizzard struck a deal with the EEOC that included $18 million for victim assistance and measures to stop harassment and end a toxic workplace culture. Even before the settlement, CEO Bobby Kotik made changes to the company to address issues raised by the EEOC and others.

Less than a month after the ruling, the DFEH requested to intervene in the settlement. The ruling will make Activision Blizzard satisfied with its current complaint and potentially open the way for the company to remove evidence that DFEH could use in its case, the ruling said. The agency said the intervention was necessary to "protect the interests" of California workers, to comment on the consent order, and to pursue a fair trial.

DFEH Appeals through DocumentCloud Dale S. District. Fisher disputed the DFEH's argument and declined the offer in December. Judge Fisher ruled that the department was not in the interest of the party involved. He said the scope of his argument allowed the DFEH to "interfere with nearly every employment activity in California." Fisher also wrote that his claim that Activision Blizzard would be free to destroy evidence was at best speculation. On Friday, the DFEH announced its intention to reconsider Judge Fisher's decision to refuse to intervene (above).

Activision Blizzard has not seen an end to the controversy sparked by the workplace scandal. Employees and others have called for CEO Bobby Kotik to resign, and many of the company's long-term partnerships have soured. These negative feelings have even led to seemingly unrelated incidents, such as the company's decision to fire several temporary QA employees at Raven Software Studios. So far, the board of directors has supported Kotik, allowing him to work at reduced wages through negative press and lawsuits.
